1. Service provider identification

In these Terms, "Diamond Signal", "we", "our" and "us" refer to the company above. "You" and "your" refer to the user or subscriber of the service.

2. Nature of the service

Diamond Signal is a statistical analysis terminal applied to sport, for educational and informational purposes. The service applies proprietary mathematical models to public data relating to professional sports competitions (notably Major League Baseball and National Hockey League) to produce:

• probabilistic projections of game outcomes;
• divergence indicators relative to public prediction markets;
• confidence indices and team form analyses;
• a public history of past projections and their accuracy.

Diamond Signal analyzes, measures, publishes. It is the reader's responsibility to interpret the figures displayed and to act as they see fit, in accordance with the laws of their jurisdiction.

2.1 What Diamond Signal is not

Diamond Signal is not a sportsbook, is not a betting operator under Canadian law (including section 207 of the Criminal Code) or any foreign equivalent, is not a tipster service or pick provider, and is not a prediction-market broker. The service does not receive, hold or transfer any wager placed by the user, does not offer any odds, and does not execute any transaction related to a bet, whether in cash, cryptocurrency or any other instrument of value. The service does not formulate any betting recommendation and does not designate any "winner to play": the "favored team" label that may appear in the interface is a statistical observation (the team whose projected win probability is above 50%), not a recommendation.

All editorial output produced by Diamond Signal — projections, posts, emails, notifications — is governed by our public editorial policy available at diamond-signal.com/editorial-policy, which prohibits any incitement to bet and enforces a systematic technical anti-gambling filter.

2.2 Educational and entertainment purpose

The service is provided for informational and entertainment purposes only. Diamond Signal does not provide investment advice or any other form of professional advice. Projections are statistical estimates and do not constitute guaranteed predictions.

2.3 Automated decision-making

Diamond Signal relies on statistical models and automated filtering algorithms to produce its projections, rank its signals by confidence and filter its content. In line with Quebec's Act 25 (s. 12.1) and the principle of algorithmic transparency, the user is informed that:

• the projections displayed result from automated computations (probability calibration, ensembling) without real-time human intervention;
• none of these processings produce a legal effect for the user, nor do they grant or deny access to any product or service based on a profile;
• the main parameters of the models (sources, methodology, limitations) are documented publicly on the Methodology page.

3. Registration and user account

3.1 Account creation

Registration requires a valid email address. Authentication uses a magic link sent by email or third-party identity providers (Apple, Google).

3.2 Accuracy of information

You warrant that the information provided at registration is accurate, complete and up to date. You are solely responsible for the confidentiality of your account and all activities that occur under it.

3.3 Minimum age

The service is intended for individuals at least 18 years of age. By registering, you represent that you have reached this age.

3.4 User jurisdictional compliance

By subscribing to the service, you warrant that your use of Diamond Signal is lawful in the jurisdiction from which you access it. It is your responsibility to verify the legality — particularly with respect to laws on sports betting, prediction markets and sports statistical analysis — applicable at your place of residence and place of connection.

Diamond Signal additionally enforces a server-side geographic restriction policy: access is denied from certain countries and certain subdivisions where the service cannot be offered. The list of restricted jurisdictions may evolve without notice. Any attempt to circumvent this restriction (VPN, proxy, falsified location) constitutes a breach of these Terms and triggers immediate termination of the account.

4. Pricing and payment

4.1 Subscription plans

• Monthly plan: USD 49 per month, billed monthly until cancellation.
• Annual plan: USD 490 per year, billed once at signup, with automatic annual renewal.

Prices are displayed in U.S. dollars (USD), exclusive of applicable taxes. Taxes (GST, HST, QST or others) are calculated and added at payment time according to the subscriber's jurisdiction of residence.

4.2 Payments

Payments are processed by Stripe Inc. Diamond Signal does not directly store or process your payment card information. By subscribing, you accept Stripe's terms.

4.3 Trial period

New users receive a free trial period of fourteen (14) days, with no commitment and no payment card required. When signup is made using a valid referral code, the trial period is extended to twenty-eight (28) days (14 standard days + 14 bonus days). Upon expiration, access to the service is suspended until a paid plan is purchased. Only one trial period per user is permitted.

4.4 Price lock

As long as your subscription remains active without interruption, the subscribed rate remains unchanged, even in case of price increases for new subscribers. An interruption followed by a new subscription is governed by the rate in effect at the new subscription date.

5. Cancellation and refund

5.1 Cancellation

You may cancel your subscription at any time from your dashboard (Stripe Customer Portal). Access to the service remains active until the end of the already-paid billing period.

5.2 Non-refundable subscriptions

Subscriptions, whether monthly or annual, are non-refundable once payment has been made, except where mandatory legal provisions in the consumer's jurisdiction of residence provide otherwise. Before any paid subscription, new users are offered a free trial period of fourteen (14) days (article 4.3) allowing them to fully evaluate the service without financial commitment.

6. Limitation of liability

6.1 No accuracy guarantee

Statistical projections are estimates based on historical data and mathematical models. Diamond Signal does not guarantee the accuracy, completeness or timeliness of the information provided. Past model performance does not guarantee future accuracy.

6.2 User decisions

You are solely responsible for how you use the information provided by the service. Diamond Signal shall not be liable for any decision made on the basis of the service's content, nor for any direct, indirect, incidental or consequential consequences arising therefrom.

6.3 Liability cap

To the fullest extent permitted by applicable law, Diamond Signal's total aggregate liability to you, for all causes combined, is limited to the total amount you paid to the service in the twelve (12) months preceding the event giving rise to the liability.

6.4 Force majeure

Diamond Signal is not responsible for any failure or delay in performance resulting from circumstances beyond its reasonable control (third-party API outage, hosting provider failure, force majeure, etc.).

7. Intellectual property

All content of the service — models, projections, text, graphics, logos, trademarks — is the exclusive property of Diamond Signal and is protected by Canadian and international intellectual property laws. No part of the content may be reproduced, redistributed, resold or used for commercial purposes without prior written authorization.

Your subscription grants you a personal, non-exclusive, non-transferable and revocable license to use the service for personal purposes only.

8. Prohibited conduct

You agree not to:

• share your account with a third party;
• circumvent security measures or service limits, including geographic restriction;
• engage in automated scraping of the content;
• redistribute, resell or publicly disclose subscription content;
• use the service for purposes that are unlawful in your jurisdiction;
• use the service's content as a vehicle to solicit, promote or facilitate any betting or gambling activity towards third parties.

Any breach may result in immediate termination of your account without refund.

9. Personal data

The processing of personal data is governed by our Privacy Policy, incorporated by reference into these Terms.

10. Modification of terms

Diamond Signal may modify these Terms at any time. Changes will be notified by email and published on the site with a new last-updated date. Continued use of the service after modification constitutes acceptance of the new terms.

11. Termination by Diamond Signal

Diamond Signal reserves the right to suspend or terminate your account in case of breach of these Terms, non-payment, or behavior detrimental to the service or its users. In case of termination not attributable to the user, any unused subscription balance will be refunded pro rata.

12. Governing law and jurisdiction

These Terms are governed by the laws of the province of [PROVINCE] and applicable federal laws of Canada. Any dispute shall be submitted to the exclusive jurisdiction of the courts of [CITY, PROVINCE], Canada, except where mandatory legal provisions in the consumer's jurisdiction of residence provide otherwise.

13. Severability

If any clause of these Terms is held invalid or unenforceable by a competent court, the remaining clauses remain in effect. Failure by Diamond Signal to exercise a right hereunder shall not be construed as a waiver of that right.
